A skilled litigator with twenty years of experience, Neil handles high-stakes corporate and commercial litigation at first instance and before appellate courts, including the Supreme Court of Canada. He has extensive experience in corporate restructurings and insolvency matters, as well as injunctive relief.
Recent distinctions (2020)
Currently represents Quebecor Media in various proceedings before the Canadian Radio-television and Telecommunications Commission (CRTC), the Quebec courts and the Federal Court of Appeal.
Successfully represented litigation funder Bentham IMF before the Supreme Court of Canada in proceedings relating to the companies formerly known as Bluberi Gaming.
Obtained the dismissal of a $55 million auditor’s liability claim relating to the bankruptcy of Groupe Melior, the decision being upheld by the Supreme Court of Canada.
Currently represents the largest shareholder of North American Lithium in the context of its proceedings under the Companies’ Creditors Arrangement Act (CCAA).
Successfully represented the ad hoc committee of bondholders of Nemaska Lithium in proceedings under the Canada Business Corporations Act (CBCA) and Companies’ Creditors Arrangement Act (CCAA).
Successfully defended the Ontario Teachers' Pension Plan and other investment funds in the $1.2 billion lawsuit relating to the failed privatization of BCE Inc.
Successfully represented Goldman Sachs in the litigation relating to the $2 billion acquisition by Shaw Communications Inc. in the restructuring of CanWest Global Communications Corp.
Acted as Quebec counsel to the official committee of unsecured creditors in the restructuring of AbitibiBowater Inc.
Acted on behalf of the court-appointed monitor in the CCAA proceedings relative to the Montreal Maine & Atlantic Railway.
Acted for National Bank Financial Group in the Asset Backed Commercial Paper (ABCP) restructuring and related litigation.
